It is - it's two "ladies" (and I use the term extremely loosely) who I got in a tangle with a while back. Some serious jealousy involved. Nothing worse than a teacher superceded by a student - who then has it thrown in her face when she tries to laud it over said student.

Roj, I don't usually follow the art threads, so I am probably asking an ignorant question.

But here goes.

Just to be clear. Are all those themes including taskbar, sidebar, wallpaper etc all your work?

Heavens no - and I never claimed they were. In fact, in most of the postings I credit the creators of the visual styles and provide links ot them. The creators of those visual styles are all my friends and happy to see me make sidebars to match them. In all cases, I have beta tested their styles for them and if you follow the links, you'll find me listed as a contributor.

The only work that is mine is the sidebar skins.

I see reposting and reposting as a stated 'this is what I'm going to do if you do not give me an apology' before you have given them a opportunity to apologize is short sighted at best. For one thing you want the apology to be genuine...as in we sincerely are sorry...we acted in haste...and we were wrong. To have an apology due to a threat (which you would never get anyway) is no apology at all. Somebody telling me something about honey and bees or something.:foureyes:

Reposting and reposting is, in my opinion, something an 8yr old would do. Why bother? Why waste your time? It went wrong...reposting and reposting is never going to make it 'right' no matter what the outcome. You're better than they are. Now just act like it.:cool:

This was all good though because in reading your profile I finally figured out what is at the root of that 'difference' and 'antagonism' between us.

Nice post acushla. I totally agree.

And Roj, I think you will agree also, now that you have had time to calm down and think about it.

I learnt some time ago never to respond to someone (especially in writing) when you are angry or upset. It is amazing how different the response can be after you have had time to calm down and think about the situation.

But we all make mistakes. :)

I think you are wrong on you copyright remarks, but I'm no copyright expert. Taken from the wikipedia article (http://en.wikipedia.org/wiki/Copyright#Obtaining_and_enforcing_copyright), which describes it as I think it is:
In all countries where the Berne Convention standards apply, copyright is automatic, and need not be obtained through official registration with any government office. Once an idea has been reduced to tangible form, for example by securing it in a fixed medium (such as a drawing, sheet music, photograph, a videotape, or a computer file), the copyright holder is entitled to enforce his or her exclusive rights.

I think you are wrong on you copyright remarks, but I'm no copyright expert.I can tell you from first hand experience that in Canada...Copyright Law is confusing at best.

As a Photographer I am deemed to be the copyright holder if I have the original negative and nobody has any signed documents from me stating that I have given up my copyright 'rights'. How this is determined when it comes to a painting/drawing...I have no idea...but I betcha it takes up at least a chapter in a book!:foureyes:

Whether you are able to uphold the copyright in court is another matter.

My guess is that they're not going to do SFA about it - given that I've heard the same from others. They do what they do and that's that. I don't expect an apology or even an indication that they have received any contact from me.

So I will repost if I do not receive any comment form them within the next day.

Apology genuine? This is a buerocracy and that's never going to happen - organizations like that don't work that way. They brush things under the rug and continue on their way.

So I will do the same - and reposting is my equivalent.

Finally, the legal ramifications are to me. If I lose a security certification because of their bullshit, you bet your sweet ass I'm going after them in court. They're messing with my livelihood and career.

Because it had 19,000 downloads and was still being downloaded at the rate of 100 a day. Because it was the most successful skin I had and I like others to enjoy it. Because I'm a stubborn cuss and don't take shit form a two-bit management team who wouldn't recognize a copyright violation if it reached up and bit them in the ass.

And most of all, because I'm Right.

I was not aware of all the 'facts' surrounding this story. Knowing more I understand more...and can better empathise with you.

How much better it would be if there was an avenue 'behind the scenes' to discuss this with someone sensitive to your concerns and have it resolved to your satisfaction with no feelings of animosity.

I gather that's just a fools dream.

Alan, I'm not ragging on you. It's like having a prize photograph that you spent time and effort getting just right - a prize winning one, no less - and then having someone say "you stole it".

My skin was the most downloaded desktop sidebar skin on the site. a landmark. and now it's gone. that's why i'm pissed.

I wanted a clearer understanding of what was happening...and perhaps be lucky enough to offer some sort of insight.

With this post I fully comprehend what you are saying and all I can tell you is that when two photographs of mine were stolen from a exhibit I went straight to the Police and reported it.

Having said that I personally feel that all you are achieving now is to immerse yourself in the anger, the injustice and a few other adjectives I can't think of right now.

I'd say...do yourself a favour, accept it...move on. Eventually it's what you're going to do anyway.

Either that or they'll be pushing crayons underneath the door to your cell.:cool:
