bahhh the hell with it

i'll just keep what i've done for myself
i did it mostly on a whim to skin elements i hadn't done before. (all 3 bordersets, heavier use of overlapping, and skinned visual on both mini and large modes)

i made 12 color variations and each has a "winshade", an encoder extension in all modes that overlaps playlist. i didnt bother with charset and timerset to match because i dont like the way the original is winamp.

i learned ALOT from doing it tho

I dont remember who it was that asked for a port of new winamp default skin but heres a look at the full size. the winshade version is mostly done too.

You dont need any damn permission for it....look at all the other ports of winamp, qcd, etc default skin ports and doubt any people asked Matt for permission. Go for it realease it here!

well, here's my view. maybe nobody cares, but here it is

there are two concerns here: plagiarism and copyright

plagiarism
taking someone's words or ideas as if they were your own

copyright
the right to copy belongs to the original creator of the piece

as long as fatal error is not trying to represent that the graphic design is his and cites his sources, he is safe from plagiarism. but since porting a skin at least is partly a copying operation (the graphic design part), the author's permission is needed before he can distribute it.

They have discussions on this ad nausiem on skinning sites, but I don't want to try to address it from that standpoint. My only comment is that it would show respect for the original skin author if permission was asked before distributing. Porting is done all of the time with permission, and most authors are happy to share...

With the fuss created by the TSF guy on porting skins and patents and the other things, I don't thing asking for permission on the Winamp forum will be a good idea.

I don't like green but that is my opinion... I asked for the blue shade for that very same reason.:)

If you look inside the skin.xml file of the Modern skin it says that the author is Sven Kistner. The email address given is bartibartman@nullsoft.com. It would probably be worth a try sending a request to that address as well, since it's different from the other email address and he hasn't responded to your first request.

i don't think this is anything more than we know already, but...

looking at member list of the winamp forum, i found a bartibartman
registered 8-25-2002 with 58 posts, last post on 12-07-2002 and then he disappeared in the middle of that discussion. he seems to be pretty well known for his MMD3 skin, which has been ported to QCD with a note that it was ripped from the skin by Sven Kistner. looks like he has a history of not answering emails requests.

I found This Thread (http://www.jetaudio.com/forums/showthread.php?t=106), where someone on that board had ported his MMD skin, but needed permission (just like you're doing with this skin.) before releasing it. The author of the skin (as well as this new Winamp 5 skin) responded and stated that he'd got slammed with emails by the worm virus, and sometimes doesn't get to answer all his emails anyway. But he said as long as he got credit within the skin file, he was fine with it (though he requested a name change). But here is the direct quote from him:

Hi Martin,

I didn't mean to not answer your main. Right now I'm being flooded with Mails thanks to the new worm ...

Although we use Spam and Virus Filters, I still get about 100-200 mails a day, and sometimes I'm a bit too fast deleting the mails
(Before the Virus/Spam Filters there are up to 10000 messages a day *gulp*)
That's probably because my Email adress is posted on Winamps page.

To the Skin. Normally I don't have a problem with porting skins, as long as I don't want to make a skin for this system/program myself. There are allready a few on the net.
I wasn't planning a skin for JetAudio. So you can release your skin. Just a little thing. It shouldn't be called MMD3 or anything like it. (MMD = metrix metal dream). Because that would be a reference to the Firm Metrix. I'm sure you will find a nice name. In the readme you can of yourse say that the Grafix are from the MMD3 skin and that you have gotten permission from the Auther.
Well, actually you should really really do this, otherwise you will be getting mails from people because you have stolen the Design ....

So from what I gather... unless he has an original skin in the works for a player like QCD, he doesn't mind his other work being ported over - as long as he gets credit for it. Not a personal answer, but it answers the question of his stance on someone porting one of his skins.

I was forwarded your request for porting the Winamp 5 Modern skin to the QCD. We're really happy that you loved the skin so much that you wanted to make it available for other players, unfortunately, we cannot grant you permission for publicly distributing this ported version.

This skin is exclusive to the Winamp player, as it is our new default skin, and porting it to other players wouldn't make it all that exclusive. Part of the goal in investing so much time and energy into this skin was to encourage new users to use Winamp, porting diminishes the incentive for users such as your self to ever switch :)

I will have to disagree with you on this it's a cool skin. But perhaps Fatal Error should have mentioned the fact that he was changing a bunch of aspects and colors and adding some other functions as well. Too bad they didn't allowed us to have it public.

But I will have to agree with you, for I don't see how a cool skin design will make people switch players.

The EQ/Vis/Color picker could be implemented. Could use the same skinned vis's. Fonts could be updated to match. I haven't seen the orig in a while so I forget more of the details.

I did not expect to be told no. If anything this was an effort to pay respect to the player and the skin author. your choice will be honored by me but you have managed to alienate me as a user of winamp and I'm not alone in that feeling. It is actually gratifying that you feel threatened by other media players with ported works.

yes, I think he was paid Drew. I finally recieved reply from Sven saying he forwarded my email to winamp.

my time wasnt wasted. i did learn alot, especially in the skinned vis department.
plus i streamlined my process of assembling a skin. start to finish was about 2 weeks. I ended up with 3 families (12 color variations, 4 normal & 4 "winshades" per family). I liked the skin because its very utilitarian in layout.

To your last comment, we're not threatened by other media players. If we've lost any users to other players, that's our fault, no one else's. We realize that Winamp3 wasn't what it should have been. With Winamp 5 we know that we got it right this time and we want to give users as many reasons as possible to try it out and fall in love with Winamp all over again.

Why not change the skin so that it cannot be confused with the original and in the process, improve it and create a better version? And then release it and say that the skin was inspired by the winamp skin.
I've made the last changes I intend to make. time to move on to next project.
no more ports for me.

Im serious about it not being THAT great of a skin.

Theres too much inspiration from mmd3( I know its the same author) ,
its styled like a wa2 (yuck) skin
top bar does not really match rest of player
LCD screen doesnt show that much info and is kinda unspired
its not like two toned metal hasnt been done before
limited # of color schemes (this will change)
theres a winamp logo on it:p

im talking about the real version not the version I got from my buddy fatal.

i have yet to find any chat client that doesnt suck. aim was one I hated the most just below icq.
of all of them, msn I could tolerate for longer periods of time.
